Terms for online donations

These terms set out the information provided before a donation made through the website, and the rights and obligations between FUNDACIÓ PRIVADA CEMCAT, Edifici Cemcat, Pg. Vall d’Hebron, 119, 08035 Barcelona, tax ID G66665001, and the donor.

1. Purpose

They govern donations made through the Foundation’s website. The donor must complete the form with the data required and accept, without reservation, the terms published at the time of access. The terms should be read in full each time a donation is made. The terms in force at the time of each donation apply.

Payment is taken on the donation form, a service of the Foundation that is separate from this information website. By continuing, the donor also accepts what that form states about card payment.

2. Who is a donor

A donor is a person who accesses the site, provides the required data, makes a donation by following the instructions and has accepted these terms. The Foundation may cancel a donation if the information is considered false or unreliable.

3. Acceptance

The donor states, on their own responsibility, that they are of legal age, that they have read these terms and the instructions for making a donation in full, and that they accept them without reservation.

4. How to donate

To make an online gift, complete the form the Foundation provides in the donation section. Payment is made by card.

5. Donation certificate

After the donation, and as soon as possible, the Foundation will send a donation certificate to the email address given on the form. The certificate confirms the gift and can be used in a tax return. If it has not arrived within a week, write to lopd.fcemcat@cem-cat.org.

6. Privacy

FUNDACIÓ PRIVADA CEMCAT is the controller and processes the data in line with Regulation (EU) 2016/679. The purpose is to manage gifts and contributions received. Data is kept while there is a mutual interest in that purpose and for the periods required by law. When it is no longer needed, it is deleted with appropriate safeguards.

Data is not shared with third parties except where the law requires it. Data included in documents that show how funds were applied will be available to the Protectorate, the Commission for the Surveillance of Terrorist Financing Activities, Sepblac or its support bodies, and the administrative or judicial bodies competent in the prevention of money laundering or terrorism. Data is not transferred internationally; if a transfer were made, express consent would be requested.

The legal basis is performance of the donation relationship. Donations may be anonymous, except when the donor chooses to include their data (name, surname, identity document, postcode, email and telephone); when the amount is 100 euros or more, under article 42 of Royal Decree 304/2014; and when a tax certificate is requested.

You may withdraw consent, access your data, rectify it, erase it, restrict processing, object and request portability. You may also complain to the Spanish Data Protection Agency (aepd.es). The Foundation has adopted the technical and organisational measures needed to protect the data.

7. Law and jurisdiction

Spanish law applies to any dispute or conflict over the interpretation of these terms and to any matter related to the donation.
